Enfinitea, LLC Retail Terms & Conditions
.95 Cent Trial Pack - This trial pack is strictly limited to one per person. After 10 calendar days from date of purchasing the trial pack, you (the customer) will be put on re-occuring billing/shipment of the standard 30-day Enfinitea unless you cancel before the 10 day trial period. Monthly billing/shipment of Enfinitea at regular retail price will continue until a cancellation notice is received by fax at 801-454-9499.
Agreement - the Term The term of this agreement may be subject to change at any time. Each customer agreement will self renew monthly so long as the customer remains active.
Cancellation - The customer may cancel their customer agreement at any time and for any reason by notifying the Company and their sponsor in writing (email) of their decision to cancel.
Company - Enfinitea is a well-established company with retail operations and/or Network Marketing offices in different parts of the country. Enfinitea markets its products and services through Independent Contractors, called customers. Each customer helps the Company by selling products that they purchase to their personal customers. customers also sponsor other customers.
Copyright - US Copyright Statues protects Enfinitea materials. All rights are reserved, including the right to alter, revise and reprint these materials in whole or in part. Reproduction in any form or by any means, electronic or mechanical, including photocopy, recording, or any information storage and retrieval system is not permitted now or in the future. Because of the copyright (and the technical information required to market the Company opportunity), no one shall have the right to reproduce for personal use or for sale any marketing materials, literature, logos, recorded Company events, speeches, flyer's, videos, brochures or other aids relevant to Enfinitea without prior written consent of the Company. This policy includes any advertising on the Internet. A customer may not use Company name, logo or product names on a web site that has not been approved by the Company. Producing or using unauthorized materials will be grounds for immediate termination. CORPORATIONS, SOLE PROPRIETORSHIPS & PARTNERSHIPS Corporations, Sole Proprietorships and Partnerships may become a customer. However, one individual must be designated as the responsible party for the Company's actions and must sign the customer Application.
Governing Laws - These rules are governed by the laws of the State of Utah and shall be governed in all respects thereby.
Insurance - Company Enfinitea maintains sufficient insurance to protect the Company and its customers against product claims as long as customer is marketing the products under proper guidelines (these Policies & Procedures).
Method of Payment - Visa, Master Card, American Express, Discover, or Echeck can pay for customer's orders. All funds should be in United States Funds. The Company does not ship COD. Customer is aware of the quality of products offered by the Company and the other costs and contractual obligations that occur when she/he purchases products from the Company. Customer understands that he/she maintains a greater responsibility when ordering on a credit card account as an informed customer than when ordering as an average customer. customer waives the right of cancellation or refund on any order placed on Visa Card, Master Card, American Express, or Discover Card account(s) except through Enfinitea. Any order returns, refunds or exchanges shall be done through Enfinitea and not through Visa, Master Card, American Express or Discover Card.
Non-Waiver - Enfinitea reserves the right to waive any provision of these Policies & Procedures. However, failure of Company to exercise any rights in any area of this Agreement shall not constitute a waiver of the Company’s right to demand compliance therewith. Waiver of any requirement may only occur by express written waiver executed by an executive officer of Enfinitea. Any waiver shall not constitute or operate as a waiver of any prior or subsequent breach of said area or any other area, term or condition.
Privacy Policy - We at Enfinitea collect personal identifiable information when needed, like names, addresses, social security numbers, email addresses, etc., when voluntarily submitted. The information you provide is used to fulfill your specific request. Privacy protection is critical to our business and the protection of our Customers and customers. Enfinitea may use tracking technology depending on the features offered. Tracking technology/cookies may be used to help customize the site for visitors and help Enfinitea better understand how visitors use the site. Personal information cannot be collected via cookies and other tracking technology. We at Enfinitea are not responsible for information that is obtained independently by third parties as a result of your use of the Internet. We may share information with governmental agencies or other companies assisting us in fraud prevention or investigation. We may do so when: 1) permitted or required by law. 2) trying to prevent against or prevent actual or potential fraud or unauthorized transactions. The information is not provided to these companies or entities for marketing purposes. Your personally identifiable information is kept secure. Only authorized employees, agents and contractors (who have agreed to keep information secure and confidential) have access to this information.
Repackaging of Products - Enfinitea products cannot be repackaged, relabeled or tampered with in any way.
Reshipments - If after three (3) attempts at delivery your parcel is returned to the Home Office, customer or Retail Customer will be responsible for reshipping charges. Retail Price/Retail Sales The Enfinitea program is built on retail sales to the ultimate consumer. Enfinitea recognizes that customers may wish to purchase products in reasonable amounts for their own personal use. Enfinitea retail pricing may be subject to change at any time. For this reason, Enfinitea will recognize as a retail sale purchase by non-participants and/or purchases by customers for personal or family use in reasonable volume which are not made for purposes of qualification or advancement.
Shipping - All orders must be sent to a physical street address. P O Box numbers, general delivery nor COD orders will be accepted. United States Priority Service is the usual form of shipment. The ordering customer or retail customer absorbs all shipping and handeling costs. Products are not shipped until funds have cleared.
